Anyways we went to court to resolve the issue and I won. The judge ordered him to pay me what was due and he has 30 days to pay. I am so happy as long as he pays like he is supposed to. Would of been in his best interest to solve this whole thing out of court it would of saved him a few bucks. |

Congrats. Looks like you hung in there and it paid off.
However, getting a judgement and collecting on it are two different things. Assume he will not just wander by with the money. It sounds like he is self employed and that makes collecting tougher since you can't garnish his paycheck. DO NOT wait for the 30 days to pass. Start figuring out what assets he has that you can attach. Start with real estate (county treasurer's office or recorder of deeds can tell you what he owns). Then find any cars or boats (stuff with titles that leave a paper trail). Depending on how the law works there you will have to go after assets through the sheriff or whatever-- regardless of who does it, having a list of assets you can hand them helps a great deal.
Hate to sound negative, but this creep has fought you so far and his attitude probably hasn't improved. You still need to turn that judgement into money. Good Luck |

| You are right having a judgement against him and collecting upon it are two different things. I know he was looking for a regular job since he did body and paint out of his home before so maybe just maybe he has found a real job. Otherwise every month he doesnt pay interest is paid on the judgement cost at 8% a month. Heck that is more then banks pay on savings accounts. I just want to be over and done with this whole situation and move on. |

| 8% per month???? damn, that's an APR of 96%! hell, don't try to collect for a year, and then double your money! |

| Hmm..8% maybe that is high. I am pretty sure that is what the lady told me when I called to check on the status of the judgement. Should have the papers from the court with all the details tomorrow. |

| Well I had the 8% right but that was for the year. Would of been nice if that was monthly. It only works out to be about $17 extra a month. |

| Can't you get the sheriff to seize some of his assets if he doesn't pay up? |

| If he doesnt pay I have to go back to court so they can get him back to come back in and testify how he plans to pays this judgement. Then at that time I can go against his personal proerty or garnish his wages. I will try to get it contact with him this afternoon to see how he plans to go about this. |

| congrats on the win, justice in court at least. that is worth somthing but doesnt put the green in your pocket or get the bus finished. what i did when my 67 was rearended badly, was a title search. well the loser and her mom, the girl was a minor, were claiming no income to pay me full payment. well the title search found that the mother owned a home valued at 125k. well my lawer filed a legal document that if she didnt pay me in full in x amount of days, we were booting her ass to the curb and the house was up for sale. we would get our money due to me, and she would get the rest. what ya know, i had a check in full, in 2 days. that gets the point across real quick. it cost me another 200 bones for the title search and additional lawyer fee's. but i had cash in hand, and bought the 57 oval. ahhhhhhhhhh sweet justice in the end. now i roll my oval i always wanted! best of luck to you on getting payment dan! josh. |

Interest on judgements is high, and I believe it's for a reason -- to make the debtor pay up. As we speak, I am trying to collect close to $1000 in back child support from my ex. Her lawyer tried to song and dance the contempt charge, but to no avail. To add insult to injury, my lawyer rubbed salt into the wound while we were calculating what she owed by saying, "Oh, and don't forget the 10% interest on top of that".
I remember the original post to this and I agree with the earlier advice, which is to start figuring out how to collect. File a lien on his house or any other real estate. Start asking questions from people in the know. Getting a judgement is one thing, but getting paid for it is quite another. |
