was it welded out of skew( the usual)
I hope you did not use the cheezy fiber gaskets they give you in the kit.

you need to get a " muffler installation kit" which comes with the metal type factory style gaskets.

and you may need to double up the gasket if you cannot manipulate the manifold part of the riser to get it to fit any better

I got the install kit and used the right ones.. i'm goin to try one more gasket first and if that doesn't work then i've been told that i can bend my heat riser tube with a tourch

You don't need a torch to do that,,, a big screwdriver behind it to pry and guide, and a big ball peen hammer with some well placed blows will do the trick. and also a phillips in the holes to align it...

I got it to aligne up but i keep brakeing bolts trying to get it down further.

get stronger bolts! get some stainless 1/4 inch a good 1 1/2 long and then some 1" too. start tightening the thing down and every few turns whack the top curved bend part of the heat riser tube with a big hammer and tighten it a bit more... unless your talking about a 1/2" gap or something you should be able to close it up.

then use the shorter ones if the long ones interfere ( one side might)
