no W-2...getting pissed

Hey folks,
I have been pestering my former boss for almost three weeks now for my W-2, and he keeps giving me a song and dance about them not being ready yet...so, I called his CPA today and asked what the deal is. apparently, my former boss owes the CPA money, so he won't release the tax information, making impossible for my former boss to send it on to me.

WHAT SHOULD I DO ABOUT THIS??

any ideas? what is my next step, short of filing a formal complaint with the IRS? any CPAs out there?

I think by federal law all W-2s must be mailed by January 31st.

Tell them you'll call the IRS. But then how much do you like your job?

Hell it's only Feb.

If you use a program, just put in dummy numbers that are close, go through the rest of the program.

Then when the fucker gives you your W-2 go put the real numbers in.

Then WEEP and WHINE at how much tax you have to pay

well, I love my new job. my delinquent W-2 is from my old employer...he is notoriously late with everything. Mad

I should get some back this year, but not much, as I try to keep it even-up so they don't get to invest my loot for 13 months at a time...little punkins skim off the top of our hard-earned money!

If you have your last paycheck from your job and you quit well before December, all of the numbers you need are on that paystub.

Call the IRS and ask them. I had the same problem a couple of years ago and all they (IRS) wanted was a photocopy of my last paystub with the reason for not having the W-2.

Got mine back already Very Happy

federal law requires that ALL employers, old or new, have their w2's mailed out by January 31st.
I had an old employer do this once, I called the labor board and the IRS.
I had a w2 hand delivered to me the next day from said employer with a formal apology and money to have my taxes done at a tax shop...

I believe it is also illegal for the CPA to with hold the W2's. Even if they are owed money!

The employer is the one required to give you the W2, not the CPA. As a CPA, if I was the one outsourcing the payroll tax function of the company and I didn't get paid, I would tell you the same thing.

You need to lodge a complaint to the IRS.

I realize that the employer is the one that this falls back on, but this is a tight-knit community, and I know the CPA. thats the only reason I would ask him for it.
