Hi,
I want to scan old articles from magazines and put them on my website. They are of course copyright protected and I want to license them. My problem is: I have an article from a magazine where the publishing company is possibly out of business.
A google search found no publishing company under the name and the address on google maps has no publishing company under the address.
I also searched the U.S. Copyright Office with no result.
How can I find out, who has the copyright?
One more thing: The magazine is older than Jan 1st 1978, so if there is a copyright still on it, someone had to renew it, it does not renew itselfs (that is how I read this question http://www.copyright.gov/help/faq/faq-duration.html#duration

Pretty much, yeah...
But as someone who deals with this sort of thing on a different level, if the magazine is out of print for more than 10 years, then there is no ownership of the article except to the copywriter and photographers. Technically, at that point the magazine owned those rights as well since they were hired help, so I think you would be ok to reproduce those for the website as long as you gave proper credits. Anything newer is going to require releases, not licensing - two different things. _________________ www.nationalsterling.org

oh, so you say there is no chance that a lawyer is into volkswagens and is reading this forum. You might be right, i will find a Porsche 356 or a 300SL forum and post it there. Or maybe another type of car, that fits the prejudice?
Of course I will not completely rely on people in this forum, but its a good start, don't you think?

Copyright, no; trademark, yes. "VW" is a registered trademark here in the States: http://vwtrademarks.com/vw.aspx?file=vwguide.htm . But I'm sure they couldn't care less if your Volkswagen forum username has "VW" in it.
People scan old articles all the time and post them on web sites, including forums; I've never heard of anyone getting in trouble for it. _________________ ~Kamz
