going back to what the OP says about "grey area" and "grandfathered in", heres the deal as i see and being in business for myself and having to comply with my local city/gov with respect to licensing,,,

I have to have 3 things hanging on my wall at me place of biz'
1, business lic
2, dealer lic
3, seller permit/resale lic

Now wether or not theres a grand fathered in zoning decision no matter what it is, what your allowed to do as a biz' is posted on your license, my says "automotive dealer, automotive repair" almost everywhere else in country works about the same way, citys just dont tell you your grandfathered in on what you allowed to do without putting it in writing.
, so your info and long winded posts read as dribble because you dont really say much, nor have commen knowledge of that business.

Getting to the point where corky is now has been going on for a long time, my guess 18-30 months, and sounds as if he just ignored it, had a bad laywer handling it or just didnt care and thought it would go away, now he' you whoever is in the mess your in.

the clean up bill from the city will not be cheap, there not doing that for free by the way, the next step will probably be the DEC to come in and do an enviromental test on the soil and grounds and that will be another whole mess, i have seen this stuff happen in the past, the issues at hand there are only starting your far from over with this deal. The DEC and EPA is the ones that will bury your or whoever in fines and clean up, not to mention that if the area is large enough with enough contamination they label it a "Superfund" site and it can not be used for anything or any business, and the property owner gets fucked out of his land if i remember well

Hi Lobotomy. No, we are not out of business for good. We have been forced to discontinue the salvage yard portion of the business. We are still licensed for car sales, repairs, the sale of new and used parts and most importantly, we are zoned correctly for it.

Because of the urgent nature of the issue, we are focusing ALL of our resources on compliance and the crushing and recycling of the scrap metal, etc.

Unfortunately, at this point the damage is done. Sunray can try to sweep things under the rug as much as he wants, but the fact of the matter is irreversible damage has been done to the public's perception of this place of business. Most people will be hesitant to do business with them after the events that have transpired...Arguing anything else at this point is moot.

Hi Dape,

It is not too late for the rebuildable cars. There will be a number of cars for sale when this is all over. We pulled many of the best cars that are decent rebuildable project cars to a safe location that is zoned correctly. We have some running cars that could be considered drivers that will be for sale. We have cars that are partially restored that need just a little work that will be for sale. We also have some very unique or unusual vehicles that were put aside because we did not want to see them crushed including 5 Type 34 Ghias. They are rough, but a professional that has welding and restoration skills could certainly build perhaps 2 cars out of the 5 and have parts left over.

It is too late for the junk cars. For instance cars that are in advanced stages of cancer, too far gone, wrecked, cut up, etc. We have contracted with Fosters Salvage to crush these junk cars and they will be recycled.

So this whole dance is an advertising hustle...shameless..




ClassicCarGuy.....your looking at a boatride...there is money back a few steps from the principals in this concern,I dont think they thought the process all the way through,the toxic cleanup part of the county equation isnt the 'push' they thought getting rid of their junk cars would be.The generator is responsible for the hazmat generated,even if its hauled off and processed,its still yours. By relinquishing it the cleanup to the county you are responsible for the costs but have no control over the method...hazmat teams,specialized hauling,lifetime maintenace of facilities,stormwater impact and aquifier issues...and they will take all of your assets...hopefully these indviduals were smart enough to protect their personal assets,I dont see a judge being leinient to their cause..

YEP YOUR RIGHT JOHNNYPAN,,,, the hazmat clean up in these cases can cost in the tens of thousands of dollars or more for a clean up and usually devestate the small biz owner financially, and the DEC or EPA doesnt care if it was that way when they got it, if your the last user on the land its your responsiblity end of story,,,!
