Does anyone make a needle and seat for the Empi 34mm pict 3 carb that will not leak when engine is not running? This is not right especially with a new carb.

EMPI? Good luck. Definitely contact EMPI, return it back if they cannot help.

Did you check the float level? If set too high it can't turn off. Remove the top and use a short piece of gas line and blow in it and push the float up and see if it leaks.
