The pull rod has a hole in one end. The pull handle is attached via a roll pin in that hole. With the assembly at rest, driving down the road. What is the orientation of the T-Handle?
I thought it was horizontal as pictured below. That position would face the ratchet teeth upwards. You pull the rod and the teeth catch on the ratchet spring plate and the rod stays where you stop.
The result of that question will answer the MAIN problem here.
The spring.
It seems that the spring tension make it point straight down when at rest. Putting the teeth at about 10 o'clock and the T-handle pointing at 2 o'clock. IS THAT RIGHT?
in this orientation, the ratchet plate slides on top of the rod until i twist my wrist to rotate the teeth upwards. And then the spring is pretty tight and could actually rotate the rod disengaging the teeth and the park brake.

You are correct that the ratchet teeth face straight up at rest. And the T-handle is horizontal (with the longer part on the right).
Your problem is that the rod isn't seated all the way forward. The pin that the spring attaches too doubles as a stop which prevents the whole thing from rotating too far counter clockwise. The spring pulls it down, but it doesn't go all the way to 6 o'clock. It hits the parking brake lever and stops at about 8 o'clock, which leaves the handle horizontal. Make sense?

yes, the lollipop is adjusted too far. as mentioned, the pin contacts the lever and acts as a stop _________________

Yes. Perfect. I assumed the eyebolt was part of the adjustment. Threading it all the way in will be the fix.
