Everyone has overlooked the possibility that you are dealing with a defective Flamingo here. The customer might be trying you get you to pay for replacing a piece of junk that was an accident waiting to happen at any time. Evil or Very Mad

It is legal to ask them to pay for some portion of the repair. Keep it simple , with cash and receipts , no โ€œworking for free โ€œ to pay it off. That will get you into trouble.

If itโ€™s a problem employee, itโ€™s probation or โ€œ welcome to your new career as a customerโ€ time. ( Stolen from Loweโ€™s)

Step one, Fire Employee
You don't want a thief on your payroll going from job to job, stealing from your customers.

I think he means his employee hit the thing with a lawnmower or some sort which knocked the legs off the giant bronze shrimp eating bird. Although it would be a bit comical to see said employee trying to randomly stash two bird legs.

I'm to invested in this, AZ Landscaper. Hope it works out for ya, gotta agree with letting customer handle repairs and pass the bill along to you(or employee later). Will cost more but will put the issue behind you.

Step two
In broken English, with a Spanish accent, say I know nothing about it, it wasn't there when we started the job.

I had to get rid of the cleaning lady that had been working for me for years.
and then the cleaning ladies my wife hired, because of her near constant bitching
about the work done, or her shit missing.
Fortunately(?) we entered the time of Covid 19, so I was able to NOT HIRE ANYONE,
and forbid anyone coming into the new house for the last 7 months.
It's been heaven!

P.S.
We are on our 4th set of Gardeners in the same 7 months since we moved, she still likes these guys, but it's only been a month.

it's certainly legal for you to fire your employee for negligence or failure to perform their duties as prescribed by you, the business owner.
i would approach this conversation with this in mind.

That would be a question for your lawyer and/or insurance company. It sounds to me like a good way to lose an employee.

As for the original question, I would bring it to a competent metal shop and see what they say. Trying some kind of repair on your own would only make it worse. Suck up the cost and claim it on your insurance.

Have client fix it to her satisfaction and send you bill. Thatโ€™s ends the cycle of dis( re) pair.

Sit down with employee and discuss who is paying what share to mutual satisfaction.

Erik G, excellent video, thanks for posting this and the link for the rods. I'm impressed this was done with low temp rods without damaging the project. I've never tried it and she sure made it look easy. I guess I'll keep what I break now. Erik G, can you post your work.

Curiosity got the better of me... Apparently a bronze (sadly not pink) can be had for a measley $1300.
